He did not immediately respond to Page Six's request for comment on whether he intended to file a dismissal or informed Lesley that he did, and neither did his lawyer.
Lesley has also declined to comment when Page Six has asked her about the contradiction between what she claims in her Instagram Story and what the court informed us.
On September 15, David submitted a petition for divorce, citing irreconcilable differences, according to court documents Page Six was able to get.
The proprietor of a construction company had just been 23 months into his marriage to his wife.
