MUMBAI. Former priest turned Activist Stan Swamy, an accused in the Elgar Parishad-Maoist case, passed away on Monday at Holy Family Hospital at the age of 84.

We record with heavy heart that Dr. Ian Dsouza, medical director of Holy Family Hospital informed us that Stan Swamy passes away at 1.24 pm today,” said a bench of Justice SS Shinde and NJ Jamadar.

D'Souza informed the court that Swamy succumbed to cardiac arrest early Sunday morning. Mihir Desai, senior counsel for Fr. Stan Swamy was being treated at the private hospital in Mumbai following a court order on May 28. The NIA had opposed a private hospital and had recommended JJ Hospital to which, he had said, “I would rather die here in prison”.

The NIA which arrested him in October from his home in almost mid-night opposed his bail request in court and had said there was no conclusive proof of his medical ailments. The agency held firm to its argument that Swamy was a Maoist who conspired to cause unrest in the country.

Last week, Swamy had filed a bail plea to challenge the draconian provision of section 43D (5) of the Unlawful Activities (Prevention) Act (UAPA) that regulate grant of bail in cases where the Act and its terror offences are invoked.

Mihir Desai, senior counsel of Swamy submitted that the body of Fr. Stan Swamy may be handed over to Fr. Frazer Mascarenhas who is the retired principal of St. Xavier college. He was often allowed to meet Swamy inside the hospital by the court.

We have no objection to post mortem being conducted”, said Desai. However, all medical and post mortem reports must be deposited with the High Court and it should be done in accordance with NHRC guidelines, he added.

Dr.Dsouza said that the cause of the death is a pulmonary infection,  Parkinson’s disease, and post Covid-19 complications.
